These Terms of Use (“Terms”) govern Your access to and use of the Yap Training Tool available at storyfirst.club/yap (“Website”/“We”/“Us”/“Our”). These Terms, together with Our Privacy Policy, set out the basis on which You may access and use the Website. By accessing or using the Website, You confirm that You have read, understood, and agree to be bound by these Terms. If You do not agree with these Terms, You are advised to refrain from accessing or using the Website.
1. About Us
The Website is operated by StoryFirst Academy. StoryFirst Academy is a trading name and does not constitute a company, limited liability partnership, partnership, society, or other separately registered legal entity. All communications may be addressed to hello@storyfirst.club.
2. About the Website
The Website is a free, browser-based speaking-practice tool. It presents a question, a preparation timer, and a speaking timer, and, where supported by Your browser, generates a transcript and a delivery score computed within Your own browser.
The Website does not constitute coaching, tuition, certification, professional assessment, diagnosis, therapy, or advice of any nature. Scores, pace figures, filler counts, and other feedback generated by the Website are approximate and are derived from arithmetic applied to an imperfect, browser-generated transcript. Such feedback carries no assessment, academic, clinical, or employment value and must not be relied upon for any decision.
Access to the Website does not require registration, an account, or payment of any fee, and is provided at Our sole discretion.
3. Eligibility
The Website is not directed at, and is not intended for use by, children under the age of eighteen (18) years. Where a person under eighteen (18) years of age accesses or uses the Website, such access shall be under the supervision of, and with the consent of, a parent or legal guardian, who shall be responsible for such person’s compliance with these Terms.
The Website is intended for general use and does not require age verification or identification as a condition of access, except where specifically stated for particular features, products, or services offered on the Website. However, We do not knowingly collect, solicit, or store Personal Data from children under the age of eighteen (18) years.
If we become aware that we have inadvertently collected Personal Data from a child under the age of eighteen (18) years without appropriate parental or guardian consent, we will take reasonable steps to delete such information from our records at the earliest.
Any parent or legal guardian who becomes aware that their child has provided personal information to us without their consent may contact us at hello@storyfirst.club, and we will take appropriate action to address the concern, including deletion of such information where applicable.
4. Licence to Use
Subject to Your compliance with these Terms, We grant You a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Website for Your own personal, educational, or self-development purposes. No other right, title, or interest is granted to You under these Terms.
5. Acceptable Use
You agree that You shall not:
- scrape, crawl, bulk-copy, mirror, or extract the question bank or any other content available on the Website;
- resell, license, rent, monetise, or otherwise commercially exploit the Website or its content;
- rebrand, white-label, or present the Website or its content as Your own;
- reverse engineer, decompile, or attempt to derive the source code or underlying data of the Website, save to the extent such restriction is not permitted by applicable law;
- use bots, scripts, or other automated means to access the Website, or attempt to overload, disrupt, or interfere with its operation; or
- use the Website for any unlawful, abusive, or infringing purpose.
We reserve the right to restrict or withdraw Your access to the Website where any of the foregoing is breached.
6. Intellectual Property Rights
All prompts, the question bank, written content, visual design, layout, brand names, logos, and underlying code available on the Website are owned by StoryFirst Academy or are used under permission or licence, and are protected under Indian copyright and trademark law and equivalent laws in other jurisdictions. Nothing in these Terms transfers any ownership of such intellectual property to You.
Certain questions are contributed by members of the community and are used with the relevant contributor’s permission; such contributors retain authorship credit and are identified on the relevant question card by the handle provided by them. A contributor wishing to have their contribution removed, or the attributed credit changed, may write to Us at hello@storyfirst.club.
No brand name, logo, or mark appearing on the Website may be used without Our prior written permission.
7. User Content
Anything You say, record, or write in the course of using the Website remains solely on Your device. We do not receive, store, or claim any right over such content, and it remains Yours entirely. The manner in which Your browser processes speech-to-text is set out in Our Privacy Policy, which You are encouraged to read.
8. Third-Party Services and Links
The Website relies on the speech-recognition features built into Your browser, loads typefaces from Google Fonts, and offers an optional email sign-up form served by Kit (ConvertKit), the script and cookies for which load automatically wherever the form is displayed on the Website. Links to social media profiles and other websites are provided for Your convenience. Each such third-party service is operated independently of Us, under its own terms and privacy policy. We do not control, and are not responsible for, any such third-party service.
9. No Warranty
The Website is provided on an “as is” and “as available” basis, without warranty of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by applicable law.
We do not warrant that the Website will be available, uninterrupted, error-free, or secure; that Your microphone or browser will function as intended; that a transcript will be generated; or that any score, word count, pace figure, or filler count will be accurate. The quality of transcription depends entirely on Your browser, device, accent, background noise, and network connectivity, none of which is within Our control.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary loss of any kind, including loss of profit, revenue, business, opportunity, goodwill, reputation, or anticipated savings, whether or not foreseeable;
- We shall not be liable for lost, corrupted, or unrecoverable recordings, transcripts, downloads, or score-cards; failure of Your microphone, browser, device, operating system, or internet connection; a session that produces no transcript or an inaccurate one; any score or feedback shown to You by the Website; or any decision, action, or outcome based on such score or feedback;
- We shall not be liable for any third-party service, including Your browser’s speech-to-text vendor (Google or Apple), Kit (ConvertKit), Google Fonts, or any linked website, each of which is governed by its own terms and policies and not by these Terms;
- Our total aggregate liability to You arising out of or in connection with the Website and these Terms, whether in contract, tort (including negligence), under statute, or otherwise, shall not exceed the greater of (i) the total amount actually paid by You to Us for the Website, being nil, and (ii) Indian Rupees One Thousand (INR 1,000); and
- nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Indian law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by Our negligence.
You acknowledge that the Website is provided free of charge and that the foregoing allocation of risk is reasonable in light of that fact.
Any claim arising out of or in connection with these Terms or Your use of the Website must be brought within seven (07) days of the date on which the event giving rise to such claim occurred, failing which such claim shall be deemed to have been waived. The remedies available under these Terms are exclusive and limited to those expressly provided herein.
11. Indemnity
You agree to indemnify, defend, and hold harmless StoryFirst Academy from and against any claim, demand, loss, liability, cost, or expense, including reasonable legal fees, arising out of Your misuse of the Website, Your breach of these Terms, or Your unlawful or infringing use of the Website or its content.
12. Force Majeure
We shall not be liable for any failure or delay in the performance of Our obligations under these Terms where such failure or delay arises from circumstances beyond Our reasonable control, including acts of God, natural disaster, failure or interruption of internet or telecommunications services, failure of any third-party service provider, governmental action, or any other event beyond Our reasonable control.
13. Changes, Suspension and Termination
We may change, suspend, limit, or withdraw the Website, or any part of it, at any time and without prior notice. We may also amend these Terms; any amended version shall take effect from the date it is posted on the Website, as indicated by a revised “Last Updated” date. Your continued use of the Website following such amendment constitutes Your acceptance of the amended Terms.
14. Privacy
Our Privacy Policy forms an integral part of these Terms and sets out in detail the manner in which Your microphone, voice, and (where provided) email address are processed. Your use of the Website constitutes Your agreement to the terms of Our Privacy Policy.

A grievance shall be accompanied by a clear and concise statement of its nature, the remedy sought, and the complainant’s contact details.
16. Governing Law, Jurisdiction and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. The courts at Delhi, India shall have exclusive jurisdiction over all matters arising out of or in connection with these Terms.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or authority of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.
18. Waiver
No failure or delay by Us in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19. Entire Agreement
These Terms, together with Our Privacy Policy, constitute the entire agreement between You and StoryFirst Academy with respect to Your use of the Website, and supersede all prior understandings, whether written or oral, relating to such subject matter.
20. Cohort Accounts
Certain programmes offered by Us (such as the 21-day reel challenge) require You to create an account. You are responsible for maintaining the confidentiality of Your sign-in credentials, for all activity that occurs under Your account, and for providing an email address that belongs to You. Accounts are personal: one account per person, and You may not share, transfer, or sell access to Your account.
21. Your Challenge Content
The videos You create for a challenge are published by You on Your own Instagram account and are governed by Instagram's own terms and policies. By submitting a reel link to Your dashboard, You confirm that the link is Yours, that it points to content You have the right to share, and You grant Us the limited right to display that link (and any publicly available thumbnail) to You and to the programme administrator for the purpose of running the challenge. We do not claim ownership of Your content.
22. Account Removal
You may request deletion of Your account at any time by emailing hello@storyfirst.club. We may suspend or remove accounts that breach these Terms, misuse the platform, or submit links to unlawful or third-party content.
23. Assignment
You may not assign or transfer any of Your rights or obligations under these Terms without Our prior written consent. We may assign, transfer, or delegate Our rights and obligations under these Terms, in whole or in part, without prior notice to You, including in connection with any merger, acquisition, reorganisation, or transfer of the business.
24. Notices
Any notice required to be given under these Terms shall be in writing and shall be sent to Us at hello@storyfirst.club, or to You at the email address provided by You, where applicable, and shall be deemed to have been duly given upon transmission.
